These terms of sale are concluded on the one hand by the company Jardin Du Lin with a share capital of (To be determined), whose registered office is located at 14 impasse de roscaroc 29830 PLOUDALMEZEAU, registered with the Trade and Companies Register of Brest under the SIREN number: 908 883 341, hereinafter referred to as "Jardin Du Lin" and managing the site https://jardindulin.com/ and, on the other hand, by any natural or legal person wishing to make a purchase via the website https://jardindulin.com/ hereinafter referred to as "the buyer". Article 1. Purpose These terms of sale are intended to define the contractual relations between Jardin Du Lin and the buyer and the conditions applicable to any purchase made through the website https://jardindulin.com/. The acquisition of a product through this site implies unreserved acceptance by the buyer of these terms of sale, which the buyer acknowledges having read prior to their order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site https://jardindulin.com/ is not directly related to their professional activity and is limited to strictly personal use and on the other hand that they have full legal capacity, allowing them to commit to these general terms and conditions of sale. The company Jardin Du Lin reserves the right to modify these terms of sale at any time, in order to comply with any new regulations or with the aim of improving the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the buyer. Article 2. Products The products offered are those that appear on the site https://jardindulin.com/ of the company Jardin Du Lin, within the limits of available stocks. The company Jardin Du Lin reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description containing its main technical characteristics (capacity, use, composition, etc.). The photographs are as accurate as possible but do not bind the Seller in any way. The sale of products presented on the site https://jardindulin.com/ is intended for all buyers residing in countries that fully authorize the entry of these products into their territory. Article 3. Pricing The prices appearing on the product sheets of the online catalog are prices in Euros (€) including all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The company Jardin Du Lin reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased according to the total amount of the order. In mainland France, for any order greater than or equal to 150 euros including tax, shipping costs are free. Article 4. Order and payment terms Before any order, the buyer must either create an account or pay directly on the site https://jardindulin.com/. The account creation section is accessible directly from the menu bar. During each visit, the buyer, if they wish to order or check their account (order status, profile, etc.), must identify themselves using this information. The company Jardin Du Lin offers the buyer the option to order and pay for their products in several stages, by credit card only: - Secure payment by credit card (via the Stripe system): the buyer selects the products they wish to order in the "basket", modifies them if necessary (quantities, references...), and checks the delivery address or provides a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier (Mondial Relay). Then, the buyer chooses the payment method of their choice: "Payment by credit card". The next step invites them to check all the information, read and accept these general terms and conditions of sale by checking the corresponding box, and then invites them to validate their order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure interface to securely enter their personal credit card details. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use thereof, the buyer may demand the cancellation of the payment by card, and the sums paid will then be re-credited or returned. The cardholder's liability is not incurred if the disputed payment is proven to have been made fraudulently, remotely, without physical use of their card. To obtain reimbursement for the fraudulent debit and any bank charges that the operation may have caused, the cardholder must contest the withdrawal in writing with their bank, within 70 days of the operation, or even 120 days if the contract binding them to it provides for it. The amounts debited are reimbursed by the bank within a maximum of one month after receipt of the written contestation formed by the cardholder. No costs for the restitution of the sums may be charged to the cardholder. Order confirmation entails acceptance of these terms of sale, recognition of having perfect knowledge thereof, and waiver of the right to invoke one's own terms of purchase. All data provided and the recorded confirmation will be valid proof of the transaction. If the buyer has an email address and has provided it on their order form, the company Jardin Du Lin will communicate to them by email the confirmation of the registration of their order. Retention of Title The company Jardin Du Lin retains full and entire ownership of the products sold until full payment of the price, in principal, costs, and taxes included. Article 6. Withdrawal Pursuant to Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of return costs. Article 7. Delivery Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Orders are carried out by Mondial Relay, a delivery service with tracking, delivered without signature. Delivery times are given for information only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer refunded. The company Jardin Du Lin may provide the buyer with the tracking number for their package by email. The buyer is delivered to their home by a Mondial Relay delivery person or to a Mondial Relay point depending on the options available during payment. In the event of the buyer's absence, they will receive a notice of passage from Mondial Relay, which allows them to collect the ordered products at the nearest Relay point, for a period indicated by the postal services. Transport risks are borne by the buyer from the moment the items leave the premises of the company Jardin Du Lin. The buyer is required to check the condition of the packaging of the goods and their contents upon delivery in the presence of the delivery person. In case of damage during transport, any protest must be made to the carrier within three days of delivery. Article 8. Warranty All products supplied by the company Jardin Du Lin benefit from the legal warranty provided by Articles 1641 and following of the Civil Code. In the event of non-compliance of a sold product, it may be returned to the company Jardin Du Lin, which will take it back and refund it. All claims, requests for exchange, or refund must be made by email to the following address: jardindulin@gmail.com, within thirty days after delivery. Article 9. Liability The company Jardin Du Lin, in the distance selling process, is bound only by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service disruption, or other involuntary problems. Article 10. Intellectual Property All elements of the site https://jardindulin.com/ are and remain the exclusive intellectual property of the company Jardin Du Lin. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual, or text. Article 11. Personal data The company Jardin Du Lin undertakes to preserve the confidentiality of the information provided by the buyer, which they may be required to transmit for the use of certain services. Any information concerning them is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the user has the right to access, modify, and delete information concerning them. Dispute Resolution These distance selling terms are subject to French law. For any dispute or litigation, the competent court will be that of Brest.
